A US judge has rejected the SEC's request to withhold documents related to former SEC Director William Hinman's speech on Ethereum.
In a ruling on February 25, Judge Sarah Netburn said the SEC's arguments were "contradictory" and "self-serving."
The SEC had argued that the speech was Hinman's personal opinion and therefore protected by attorney-client privilege. However, Judge Netburn noted that Hinman had sought legal advice from the SEC before making the speech.
"On the one hand, the SEC argues that Hinman's speech was his personal opinion and therefore not subject to the attorney-client privilege," Judge Netburn wrote. "On the other hand, the SEC argues that Hinman sought and received legal advice from SEC attorneys in drafting his speech."
The SEC's request to withhold the documents was "nothing more than an attempt to cherry-pick the facts in an effort to achieve a desired outcome," Judge Netburn said.
The ruling is a major victory for Ripple, which is suing the SEC over its classification of XRP as a security. Ripple argues that Hinman's speech shows that the SEC does not consider Ethereum to be a security, and therefore XRP should not be classified as a security either.
The SEC has not yet commented on the ruling.
