**US Justice Department appeals approval of Voyager’s sale to Binance.us**
The US Justice Department has appealed a bankruptcy court’s approval of Voyager Digital’s sale to Binance.us, arguing that the deal would “impair” its ability to investigate the crypto lender.
In a court filing, the Justice Department said that the sale would “prevent the government from pursuing its claims against Voyager and its directors and officers for potential violations of the federal securities laws.”
The department also argued that the sale would “jeopardize” its ability to recover funds for investors who lost money in the collapse of Voyager.
“The court cannot tell the government to speak now or forever hold its peace before Voyager and Binance.USwed,” the filing said. “Nothing in the bankruptcy code permits courts to exculpate parties from liability to the government for past and future conduct.”
The Justice Department is seeking to put the sale on hold pending appeal, or at least those parts of the deal that limit the government’s ability to enforce the law.
Last week, bankruptcy court judge Michael Wiles in New York approved the sale after showing considerable skepticism about the arguments by the Securities and Exchange Commission that Voyager’s VGX token might be an unregistered security.
The deal is expected to close by February 2023.
