**Grayscale sues SEC for rejecting Bitcoin ETF**
Grayscale, the world's largest Bitcoin fund, has sued the US Securities and Exchange Commission (SEC) for rejecting its application for a spot Bitcoin ETF.
In a letter to SEC Chair Gary Gensler, Grayscale argued that the SEC's decision to approve Bitcoin futures ETFs while rejecting spot ETFs is “arbitrary and capricious.”
Grayscale also said that the SEC’s decision violates the Administrative Procedure Act (APA), which requires the agency to provide a reasoned explanation for its decisions.
“The SEC has failed to provide any rational basis for distinguishing between spot Bitcoin ETFs and Bitcoin futures ETFs,” Grayscale said. “This distinction is arbitrary and capricious, and it violates the APA.”
Grayscale is seeking a court order to compel the SEC to approve its spot Bitcoin ETF application.
The SEC has not yet responded to Grayscale’s lawsuit.
