A federal appeals court has upheld a lower court's decision to dismiss a lawsuit filed by an investor who accused rapper T.I. and his co-founder of the digital streaming platform Flik of violating securities laws.
The investor, Kenneth Fedance, had alleged that he purchased $3,000 worth of Flik tokens in 2017 and that the company's founders failed to disclose material information about the project.
However, the three-judge panel of the 11th Circuit Court of Appeals found that Fedance's lawsuit was filed too late and therefore dismissed the case.
"Because we affirm the dismissal of the complaint as untimely, we do not reach Harris's alternative arguments," Circuit Judge William Pryor wrote in the opinion.
Flik was founded in 2017 by Jason Felton, who began marketing his company's tokens shortly thereafter. Harris Jr., who is known professionally as T.I., was brought on as a co-founder shortly after.
Felton's contacts, including actor Kevin Hart, took to Twitter to promote the project and its tokens, according to the documents.
"I'm super excited for [T.I.] and his new venture with @theflikio! They are gonna crush it! #ICO #BlockChain #crypto #bitcoin," Hart wrote at the time.
The tokens formed part of Flik's ecosystem, which was marketed as an "online viewing platform that [allows] creatives to sell/rent their projects."
In a separate lawsuit last year, the pair were accused of promoting the platform's initial coin offering without first registering with the U.S. Securities and Exchange Commission (SEC).
T.I. agreed to pay $75,000 and not participate in any digital asset sales until 2025.
